Permanent Residence under EU Law allows EU citizens and their non-EU family members to acquire the right to reside permanently in Ireland, after a continuous period of residence exercising EU Treaty Rights. This permission is based on EU Law and is not discretionary when the legal requirements are met.
Although the legal requirement is 5 years, the application can be prepared and submitted close to 4 years and 6 months, taking processing time into account, provided that residence is maintained until the final decision.
Criteria and eligibility
- Continuous and legal residence for 5 years in Ireland under EU Treaty Rights
- Proven exercise of Treaty Rights during the period (employment, self-employed, study or self-sufficient)
- For non-EU family members: maintaining the family bond during the relevant period
- Absences from the State within the limits permitted by European legislation

- Proof of continuous residence in Ireland
- Evidence of the exercise of Treaty Rights (contracts, payslips, tax records, academic enrolment, health insurance)
- Family bond documents (where applicable)
- Valid passport and proof of immigration status
